TO: Licensing Plate Issuing Officials
SUBJECT: Delinquent Registration Penalty for Motor Vehicles

It was recently brought to the attention of the Motor Vehicle Division, that licensing officials may be relying on a previous Division memorandum (2006-4) that provides for the assessment of penalties for the delinquent registration of trailers in accordance with Section 40-12-10(e), Code of Alabama 1975.

Please be advised that the delinquent registration penalty of fifteen dollars ($15) on motor vehicles provided under Sections 32-6-65 and 40-12-260, Code of Alabama 1975, shall include trailers, since trailers are included in the definition of a “Motor Vehicle” under Section 40-12-240(8), Code of Alabama, 1975.

The Motor Vehicle Division is working to amend Administrative Rule 810-5-1-.211 (Motor Vehicle Registration Delinquency Penalty and Interest Charges) to provide clear guidelines.
